Rule 39A
Special arrangements for promotion based on performance and experience evaluation
(1) Notwithstanding anything else written in this regulation, if a teacher who has completed at least the following service period in the post of the following category has obtained an educational qualification higher than the required minimum educational qualification at the time of entering the service, before or after entering the service, such teacher shall be promoted to the post of one category above. To be promoted:-
(a) Primary III Class – 10 years
(b) Primary II or Lower Secondary III – 12 years
(c) Lower Secondary II or Secondary III Category – 15 years
(d) Secondary II Class – 18 years
(2) Notwithstanding anything contained in sub-rule (1), the teachers of primary, lower secondary and secondary level, second and third class in the permanent post of the same category after completing the service period of 13, 15 and 18 years or more respectively at the time of entry into the service in the prescribed subject. Such a teacher will be promoted to one rank higher if he/she has obtained educational qualification.
(3) Notwithstanding anything contained in sub-rules (1) and (2), no teacher of primary, lower secondary and secondary level first class and any teacher shall be promoted in the following cases:-
(a) in the case of the restrictive phrase of rule 27,
(b) In the event that the teacher has not obtained at least seventy-five percent marks in any one of the assessment as per clause (d) of sub-section (4) of sub-rule (2) of rule 28 or the performance assessment of the academic session 2065 or 2066.
(4) The Commission shall update the record of the teacher who has been promoted as per sub-rule (1) or (2) and give the same information to the teacher library.
(5) If a teacher who has been promoted in accordance with this rule retires from service for any reason or if he is promoted to a higher position, his position will remain in the third category of the relevant level.
(6) The promotion according to this rule will be done only once and the Commission shall complete the work related to the promotion by the end of Chaitra Masant Mitra in the year 2068.
(7) The process and period of inviting applications for promotion based on evaluation of performance and experience, publication of results, and other provisions related to the procedure for complaints about promotion shall be as determined by the commission.
